What is a quiet title action in California?
A quiet title action (Code of Civil Procedure § 760.010) is a lawsuit filed to establish clear, undisputed ownership of real property. It "quiets" competing claims by asking a court to declare who holds valid title. Quiet title is appropriate when there are conflicting deeds, adverse possession claims, lien disputes, or title insurance issues. What are common title defects in Los Angeles?
Common title defects include unreleased liens or mortgages from prior owners, forged deeds in the chain of title, missing or erroneous legal descriptions, undisclosed easements, mechanic's liens, unpaid property taxes, boundary overlaps with neighboring parcels, and interests held by unknown heirs.
Does title insurance cover all title defects?
Title insurance provides protection against many title defects discovered after closing, but coverage has exceptions. Standard policies often exclude defects that would be revealed by a current survey, matters known to the insured but not disclosed, and certain easements. When a title insurer denies a claim, Warner Legal Group represents policyholders in coverage disputes and independently pursues resolution of the underlying defect.

Adverse possession is a legal doctrine that allows a person who openly, continuously, and exclusively occupies another's property for a statutory period (5 years in California) to potentially claim legal title.
